Terms of service
Terms and Conditions of the Prixiro Online Store
Valid and effective from 1 November 2026
1. Introductory Provisions
1.1. These Terms and Conditions govern the mutual rights and obligations of the seller and the buyer in connection with the sale of goods through the Prixiro online store operated at prixiro.cz and prixiro.eu, including all of their language versions (the “Store”).
1.2. The seller is Factory51 s.r.o., with its registered office at Džbánice 37, 671 71 Džbánice, Czech Republic, Company ID (IČO) 23908602, VAT ID CZ23908602, registered in the Commercial Register maintained by the Krajský soud v Brně (Regional Court in Brno), Section C, File 148096, which operates the Store under the trade name “Prixiro by Factory 51” (the “Seller”).
1.3. Seller’s contact details: email info@prixiro.eu, phone +420 722 176 505 (online support daily 8:00–21:00). Address for returns and complaints (for postal shipments only; not a shop open to the public): Factory51 s.r.o., Spálená 3, 602 00 Brno, Czech Republic.
1.4. The Store is intended primarily for consumers. The buyer is either a consumer, i.e. a natural person who enters into a contract with the Seller outside the scope of their business or independent profession, or a business (the “Buyer”). Provisions that apply exclusively to consumers do not apply to businesses. Sections 1799 and 1800 of the Civil Code do not apply to a Buyer who is a business, and such a Buyer may assert rights arising from defective performance within 12 months of receipt of the goods.
1.5. Legal relations are governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection. This choice of law does not deprive a consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
1.6. The contract may be concluded in the language of the language version of the Store in which the Buyer places the order (currently Czech, English, German, Slovak, Polish, Hungarian, Romanian, Swedish, Finnish and Danish). All language versions of these Terms and Conditions have equal standing. For a consumer, the version in the language in which the contract was concluded is decisive; any discrepancy between language versions will be interpreted in the consumer’s favour.
1.7. The Seller archives the concluded contract in electronic form; it is not accessible to third parties. The Buyer receives confirmation of the order and of the conclusion of the contract by email; these Terms and Conditions and the Returns and Complaints policy (with the information on the right of withdrawal and the model withdrawal form) are attached to the confirmation as PDF files.
2. Information on Goods and Prices
2.1. The presentation of goods in the Store is for information purposes only and does not constitute an offer to conclude a contract within the meaning of Section 1732(2) of the Civil Code.
2.2. Prices of goods include VAT. Prices are shown and charged in the currency displayed at checkout. Shipping costs, free-shipping thresholds and the price of Parcel protection are set in CZK and are converted at the current exchange rate for payments in another currency. You will always see the final total price in your currency, including shipping and all other charges, at checkout before placing the order.
2.3. Product photographs are for illustration only. Collectible models, jerseys and other licensed merchandise may differ slightly from the images shown (e.g. colour shade, placement of sponsor logos in a given season).
2.4. The availability of goods is stated for each product. Should it not be possible to deliver goods despite the availability displayed, or if a price was stated with an obvious error, the Seller will proceed in accordance with Article 3.3.
3. Orders and Conclusion of the Contract
3.1. The Buyer orders goods by adding them to the cart, filling in the details at checkout, selecting the shipping and payment method, and confirming the order by clicking the button to place an order with an obligation to pay. Before placing the order, the Buyer may review and amend the order details.
3.2. The purchase contract is concluded when the order is placed by clicking the button to place an order with an obligation to pay. The Seller will confirm receipt of the order and the conclusion of the contract to the Buyer by email without undue delay.
3.3. The Seller may withdraw from the contract only if (a) the goods cannot be delivered because they are no longer produced or supplied or are unavailable from the supplier despite the availability displayed, or (b) the price of the goods was stated in the Store with an obvious error that the Buyer must have recognised (e.g. a price off by an order of magnitude). The Seller will inform the Buyer without undue delay and refund all payments received, including shipping costs, without undue delay and no later than within 14 days. Where possible, the Seller may offer comparable goods or the goods at the correct price; the Buyer is not obliged to accept such an offer.
3.4. The costs of means of distance communication (internet, telephone) are borne by the Buyer and do not differ from the standard rate.
4. Payment Terms
4.1. You can pay by payment card, Apple Pay, Google Pay or PayPal (and any other methods shown at checkout). Payment in cash or payment upon receipt of the goods is not available.
4.2. The purchase price is due when the order is placed. Payments by card, Apple Pay and Google Pay are processed by Shopify Payments, PayPal payments by PayPal; the Seller has no access to payment card details.
4.3. The Seller will send the tax document (invoice) to the Buyer electronically.
5. Shipping and Delivery
5.1. Goods are shipped by the Seller. Goods in stock are dispatched within 3 business days of conclusion of the contract. Goods are carried by Packeta (Zásilkovna). Shipping methods and prices are shown at checkout and on the Shipping and Payment page.
5.2. We will deliver goods in stock no later than 5 business days after conclusion of the contract in the Czech Republic, 6 business days in Slovakia and 10 business days to other EU countries. If a longer availability period is stated for a product, the delivery period is extended by that period, but in total to no more than 30 days after conclusion of the contract. If we do not deliver the goods within this period, the consumer has the rights provided by law: in particular, the consumer may set us a reasonable additional period and, if it expires without delivery, withdraw from the contract, or withdraw immediately if the delivery date was essential or if we have refused to deliver. In such a case, we will refund all payments received without undue delay.
5.3. The Buyer is obliged to accept the goods. Upon receipt, it is advisable to check that the packaging is intact and to report any visible damage to the shipment to us as soon as possible. A damage report made with the carrier helps us deal with the matter, but it is not a condition for exercising your rights.
5.4. If the Buyer does not collect the parcel within the storage period, the Seller may withdraw from the contract; the Seller will refund the amount paid less the actual, documented costs of the unsuccessful delivery and return of the parcel.
5.5. Ownership of the goods passes to the Buyer upon payment of the purchase price and receipt of the goods. The risk of loss of or damage to the goods passes to the Buyer when the goods are received by the Buyer or by a person designated by the Buyer other than the carrier; until then, it is borne by the Seller.
5.6. Free shipping applies only to delivery to a Packeta pickup point or Z-BOX (in Austria, Ireland and Luxembourg, where no pickup points are available, to the delivery address; in Cyprus to BOX NOW lockers) and only to orders in which the value of goods after discounts reaches at least 1,500 CZK (Czech Republic, Slovakia) or 2,300 CZK (other EU countries); for payments in another currency the amount is converted at the current exchange rate. Otherwise home delivery is always charged according to the Shipping and Payment page.
6. Withdrawal from the Contract
6.1. A consumer has the right to withdraw from the contract without giving any reason within 30 days of receiving the goods or, for an order delivered in several parts, of receiving the last part (the Seller voluntarily extends the statutory 14-day period).
6.2. Withdrawal may be notified by any unequivocal statement – by email to info@prixiro.eu, by post to Factory51 s.r.o., Spálená 3, 602 00 Brno, Czech Republic, or simply using the online form on the Withdraw from contract page (link in the website footer). The Seller will confirm receipt of the withdrawal by email without undue delay.
6.3. The consumer shall send the goods back no later than 14 days after withdrawing, to Factory51 s.r.o., Spálená 3, 602 00 Brno, Czech Republic. Returning goods in person is not possible. The direct cost of returning the goods is borne by the consumer.
6.4. The Seller will refund to the consumer all payments received, including the cost of the cheapest delivery option offered, without undue delay and no later than within 14 days of the withdrawal, using the same means of payment the consumer used (another means only by agreement and at no additional cost). The Seller may withhold the refund until it has received the goods or the consumer has provided proof of having sent them.
6.5. The right of withdrawal does not apply to (a) contracts for the supply of goods made to the consumer’s specifications or clearly personalised (e.g. a jersey printed with a name to order), and (b) contracts for the supply of sealed goods which are not suitable for return for health protection or hygiene reasons once unsealed after delivery. These exceptions apply only to products expressly marked as such on the product page. Opening the packaging of other goods (e.g. LEGO sets, models, caps) does not exclude the right of withdrawal.
6.6. Details and the model withdrawal form can be found on the Returns and Complaints page.
7. Rights Arising from Defective Performance (Complaints)
7.1. The Seller is liable to the consumer for the goods being free from defects upon receipt and for any defect that becomes apparent within 24 months of receipt.
7.2. If a defect becomes apparent within one year of receipt, the goods are presumed to have been defective upon receipt.
7.3. The complaints procedure, the consumer’s rights and the time limits for handling complaints are described on the Returns and Complaints page. A summary of your statutory rights is also given in the harmonised EU notice on the legal guarantee in the website footer.
7.4. If a manufacturer provides its own commercial guarantee for certain goods, its terms are stated on the product page. Such a guarantee does not affect the statutory rights arising from defective performance.
8. Discounts, Newsletter and the Prixiro+ Loyalty Programme
8.1. Unless stated otherwise, discount codes cannot be combined with other discounts on goods and cannot be applied retroactively to an order that has already been placed.
8.2. Newsletter discount. Anyone who subscribes to our newsletter receives the discount code WELCOME10 for 10% off the price of goods in their first order. The code can be used once per customer (email address), only for the first purchase and only on goods included in the “Prixiro+ sleva” collection (goods to which the discount applies are marked as such on the website). The code cannot be combined with other discounts on goods (including the Prixiro+ discount); it can be combined with free shipping. Whether and to what extent the discount applies is always shown at checkout before payment. You can unsubscribe from the newsletter at any time via the link in every email.
8.3. Prixiro+ loyalty programme. A registered customer whose total spend on paid orders (including VAT) reaches 10,000 CZK obtains the Prixiro+ level with a 5% discount; with a total spend of 15,000 CZK or more, the Prixiro++ level with a 10% discount. The discount is deducted automatically at checkout when purchasing while logged in to the account and applies only to goods included in the “Prixiro+ sleva” collection. The loyalty discount cannot be combined with other discounts on goods; free shipping applies even with the discount. Spending in another currency is converted to CZK.
8.4. Cancelled orders, orders (or parts of orders) from which the customer has withdrawn and amounts refunded in connection with complaints are not counted towards the total spend.
8.5. The Seller may change or end the loyalty programme with at least 30 days’ notice, announced on the programme page and by email to members. A level already obtained remains valid at least until the end of the notice period. Details of the programme are on the Prixiro+ page.
9. Personal Data Protection
9.1. The processing of personal data is governed by the Privacy Policy.
10. Handling of Complaints, Out-of-Court Dispute Resolution and Supervision
10.1. Consumer complaints are handled by the Seller at info@prixiro.eu.
10.2. The body competent for out-of-court resolution of consumer disputes is Česká obchodní inspekce (Czech Trade Inspection Authority), Gorazdova 1969/24, 120 00 Praha 2, adr.coi.cz. Consumers residing in another EU Member State may also contact the European Consumer Centre Czech Republic (evropskyspotrebitel.cz).
10.3. Compliance with obligations under the Act on Consumer Protection is supervised by Česká obchodní inspekce (Czech Trade Inspection Authority) (coi.cz), and in the area of personal data protection by Úřad pro ochranu osobních údajů (Office for Personal Data Protection) (uoou.gov.cz). The Seller conducts business on the basis of a trade licence; supervision within the scope of the trade licence is exercised by the competent Trade Licensing Office.
11. Final Provisions
11.1. The Seller may amend these Terms and Conditions; the version in effect at the time the order is placed applies to the Buyer. The Seller archives previous versions of these Terms and Conditions and will send them on request.
11.2. The Buyer acknowledges that the Seller is not bound by any codes of conduct.
11.3. If any provision of these Terms and Conditions is invalid, this does not affect the validity of the remaining provisions.
11.4. These Terms and Conditions take effect on 1 November 2026.
